Terms and Conditions: Tour Bookings

Please read the following information carefully. You will not be able to make a tour booking until you confirm you have read and agreed to these terms and conditions.

Data Protection
By giving us your name and personal details you consent for them to be used as necessary in processing your booking and complying with legal requirements (e.g. passing guest information to tour operators for hotel transfers). We will never pass your details to other third parties or use them ourselves for marketing purposes. For further details, please see our privacy policy.

1. Booking terms

a. When making a booking you must be aged 18 years or over and have the authority to accept and do accept on behalf of all members of your party these terms and conditions. All correspondence and documents will be sent to you, the party leader. You are responsible for ensuring that the correct email address is provided for correspondence, and that our email address is on your whitelist. You are also responsible to us for all payments in respect of the booking.

b. You understand and acknowledge that Your Krabi acts solely as an intermediary (a booking agent) for the tour operators, guides, transportation providers, and any and all other service providers used in connection with your selected excursion or activity. You accept that Your Krabi does not provide any of the above services which will or may be used during your trip(s).

c. We make every reasonable effort to provide accurate information and to investigate and book with providers who are reliable and of good quality. However, you accept that it is not possible for us to continually investigate the status and availability of services offered by providers, their financial condition or other factors of quality.

d. In respect of the above, you agree not to hold Your Krabi responsible for any damages including personal injury and financial loss, which may arise from the negligence, or other actions or inactions of your tour operator and any other service provider utilised during your selected trip(s).

e. You acknowledge that the tour or activity you selected may involve inherently dangerous activities and risks and/ or that it may require extreme physical exertion. You agree that Your Krabi shall not be liable for special, indirect, incidental or consequential damages resulting from this.

f. You agree that Your Krabi shall not be liable for the loss of or damage to any baggage, equipment or other personal items during the tour or activity. Such items are your sole responsibility at all times.

2. Payment & issue of documents

a. When you wish to make a tour booking you must pay online in full and in advance. Tour bookings made through the website shopping cart system will be directed to pay via PayPal (with normal credit card, or existing PayPal account), or with PaysBuy, a Thai online payment gateway accepting Visa, Mastercard credit and debit cards. Payments in cash on arrival are not accepted.

b. Once the payment for your booking has been cleared, we will send you a confirmation voucher by tracked email. A confirmation voucher is the tour operator’s acceptance of your booking (as detailed therein), and a contract is made between you and the tour operator upon its delivery. We would ask you to check the details on the voucher: any anomaly should be reported to us immediately, otherwise the details shown on it will be presumed to be correct.

c. You are responsible for the printing of a copy of your confirmation voucher, which will be required by tour operator as proof of purchase when joining the tour. Some tour operators may allow presentation of the voucher on a screen in some cases; however this is entirely at their discretion and may involve extra checks to prove your identity. We are not responsible for any delay, inconvenience or loss this may cause.

d. You are responsible for the payment of any items not listed on your confirmation voucher (e.g. National Park entry fees, alcoholic drinks, photographs or videos of the tour) and agree to pay locally for items or services used by your party which are not included in your tour price.

e. Promotional pricing: from time to time, we may offer special discounts on certain tours or from certain operators. Promotional pricing will not apply retrospectively to any bookings made prior to the promotional period; nor will it be extended to any additional guests added to bookings following completion of the promotional period.
In addition, separate terms and conditions may apply to promotional pricing which will take precedence over these terms.

3. Cancellations and amendments

a. Cancellation by you You may cancel your tour booking at any time.
For bookings of 1 – 7 people, all tours and activities are fully refundable* if a written cancellation request is received up to 24 hours before your intended date of participation.
For groups of 8 or more, and all private charters, bookings are fully refundable* if a written cancellation request is received up to 72 hours before your intended date of participation.

If you cancel a tour or activity less than 24 hours before your intended date of participation no refund will be issued under any circumstances. Please ensure you have adequate travel insurance to cover the consequences of any unexpected illness, accidents etc.

In the event that you fail to participate in the tour or activity booked, arrive late or depart early, no refund will be issued under any circumstances.

b. Cancellation by the tour operator The tour operators reserve the right to cancel any tour at any time before departure for any reason, including dangerous weather conditions (see below) or insufficient participants to operate the tour. The minimum number of participants required for most tours is 2 adults (unless otherwise stated); should there be less than the required number confirmed at time of your booking we will inform you and offer you either a refund, alternative date, or (if desired) keep you on a waiting list.

In the unlikely event that a tour is cancelled by the operator (for any reason), you will be given a full refund*, or be allowed to reschedule for an alternative date, at no additional cost. Neither we, nor the tour operator, may be held responsible for any additional costs above and beyond the price of your ticket(s), including transport or other personal expenses, incurred as a result of such changes; travel insurance usually covers reimbursement for such eventualities.

c. Cancellation due to weather Most of the tours that can be booked through this site can be considered outdoor, all-weather activities. If you decide to cancel your booking due to unfavourable weather conditions and the tour operator deems that the weather conditions are safe enough to allow the tour or activity to take place, no refund will be given, as per the terms in clause 3a above.

In the circumstances that the tour operator deems that the weather conditions make it unsafe for the tour or activity to take place, and cancels the tour, you have 3 options:
i. You may either reschedule the same itinerary for a different day at no additional cost
ii. You may choose another itinerary for the same day (if available), paying the difference in price (if more ), or receiving a refund for the difference (if less).
iii. You can receive a full refund* for the itinerary, as per the terms in clause 3b above.

d. Amendments and rescheduling Changes to your booking pertaining to a decrease in the number of travellers and / or different date of travel or program (subject to availability) may be made at any time, with a minimum notice period of 24 hours from confirmed date of participation (72 hours for groups of 8 or more, and all private charters). No admin fee will be charged; the price of the tour or service itself will be adjusted as necessary.

Changes made within 24 hours of confirmed date of participation (72 hours for groups of 8 or more, and all private charters), will be subject to the cancellation policy outlined in clause 3a, above. This means no refund will be provided in the case of any reduction in travellers; nor in the case of your new date being unavailable.

We will endeavour to accommodate any increase in passenger numbers and / or changes to pick-up location at any time, subject to availability and sufficient notice being provided. Neither type of request will be guaranteed.

e. Cancellation of airport transfers Airport transfer service from Krabi or Phuket Airport (pick-up) may be cancelled at any time. A full refund* or free rescheduling will be provided if we receive a minimum of 3 hours notice (Krabi Airport) or 4 hours notice (Phuket Airport) during business hours (8am – 8pm). This means, for example, if you have a flight arriving at 8.30am, we will need to receive notice of your cancellation before 8pm the previous night. However, if your flight is arriving at 2pm at Phuket Airport, we will only need to receive notice of your cancellation before 10am the same day.

Cancellations to arrival airport transfers made after the required minimum notice above are strictly non-refundable. If you wish to reschedule your transfer in these cases, we will require written notice of your new flight details with a minimum of 3 hours notice (Krabi Airport) or 4 hours notice (Phuket Airport) during business hours (8am – 8pm), otherwise we will not be able to guarantee the service. We will also require your written agreement to pay an additional transfer fee to the driver in cash on arrival.

Cancellations of airport transfers to either Krabi or Phuket Airport made up to 12 hours before booked departure time will receive a full refund*. Cancellations made with less than 12 hours notice before booked departure time will receive a 50% refund.

* DEFINITION OF “FULL REFUNDS” All refunds must be made via the same channel used for payment.
A “full refund” means a refund of the amount actually paid for the tour(s) or service(s) in question, and will take into account any volume discount, promotion, or coupons applied at time of booking. It does not mean a refund of the published price for the tour / service, unless that is what was actually paid.
The period that a “full refund” (equivalent to the amount paid) will be available depends on the channel used for payment, so you are advised to take this into consideration before booking.
Any fees applied by the payment channel following this period will be deducted from your “full refund” amount, as per the following schedule:
1. PaysBuy
Payments of up to 2000 THB made via PaySbuy are fully refundable free of charge. For amounts of more than 2000 THB, PaysBuy charges a handling fee of 5% of the value of the refund, which will be automatically deducted from the amount refunded to you. Refunds are available up to 6 months after payment only.
2. PayPal
Payments made via PayPal (account or credit card) are fully refundable free of charge up to 60 days following payment. After this date, no standard refunds are possible, so we are obliged instead to make a payment to you to the value of the total amount due, using PayPal’s “send money” system. PayPal will then charge you, the receiver, a small amount (around 3 – 5% depending on your country of residence) for this service. “Sending money” refunds are available up to 1 year following payment.

Please note that Your Krabi does not charge any additional handling or admin fee for refunds. When refunds are due, we always return the funds received in full, and the payment channel deducts their fees directly from this amount.

4. Changes to published schedule & itinerary

a. You agree and accept that all tour itineraries may vary due to tidal and weather conditions without prior notice. The tour operators are experienced and any changes made will be for your safety and comfort during the trip.

5. Compensation

a. In any dispute following provision of services, you agree that in no circumstances shall Your Krabi’s total liability for any error or omission, perceived or real, exceed the total value of the amount paid for the tour or service in connection with which the liability arose.

b. You also agree that after a full refund* has been processed, we will have no further liability, nor obligation to you, neither financially nor in kind. Please ensure you have adequate travel insurance (see Clause 6b. below) in order to cover any indirect or consequential losses over and above your ticket price.

6. Travel insurance

a. The tour operators will provide a basic accident insurance for all activities and excursions, typically up to 100,000 baht per accident (may vary).

b. We strongly recommend that you take out adequate travel insurance in addition to this, to protect your belongings and travel investment. The policy should include coverage for theft and damage to personal and third party property, trip cancellation, missing travel connections, interruption or delay for medical, work, weather or natural disaster-related reasons, as well as covering boat travel and soft adventure activities, if relevant. You may also wish to include extended medical services, to cover international standard healthcare and repatriation.
